DMCA Copyright Policy

Lightenwells respects the intellectual-property rights of others and expects users of lightenwells.com (the “Site”) to do the same. This policy explains how copyright owners may report content they believe infringes their copyright, and how users may submit a counter-notice when content has been removed by mistake.

This policy applies to content submitted to the Site, including reviews, photographs, videos, comments, and other user-generated content.

1. Reporting Copyright Infringement

If you believe that material available on the Site infringes your copyright, please send a written notice to our designated copyright contact.

To help us review your request, your notice should include:

  • Your physical or electronic signature;
  • Identification of the copyrighted work you believe has been infringed;
  • Identification of the allegedly infringing material and its location on the Site, such as the relevant URL;
  • Your name, mailing address, telephone number, and email address;

2. Our Response

After receiving a valid infringement notice, Lightenwells may remove or disable access to the material in question and may notify the user who submitted the content.

We may also take appropriate action against users who repeatedly submit infringing content, including restricting or terminating access to relevant Site features.

3. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated copyright contact.

Your counter-notification should include:

  • Your physical or electronic signature;
  • Identification of the material that was removed or disabled and the location where it appeared before removal;
  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your name, mailing address, telephone number, and email address;
  • A statement that you consent to the jurisdiction of the appropriate U.S. Federal District Court; and
  • A statement that you will accept service of process from the person who submitted the original infringement notice, or that person’s authorized agent.

If we receive a valid counter-notification, we may forward it to the original claimant. Subject to applicable law, we may restore the material if the claimant does not notify us that they have filed a court action seeking to prevent restoration.

4. Misrepresentations

Please do not submit false or misleading infringement notices or counter-notifications. A person who knowingly materially misrepresents that content is infringing, or was removed by mistake, may be liable for damages under applicable law.
